Terms of Service — Maple Crest Garden Services Ltd.

1. Introduction and Acceptance of Terms

These Terms of Service (the “Terms”) govern the use of and access to the garden and landscaping services provided by Maple Crest Garden Services Ltd. (“Maple Crest Garden Services Ltd.”, “we”, “us”, or “our”), with a business address at 2450 Jane Street, North York, ON M3M 1A9, Canada.

By requesting a quote, booking, authorizing, or accepting any services from Maple Crest Garden Services Ltd., you (“Client”, “you”, or “your”) agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

These Terms apply to all services provided by Maple Crest Garden Services Ltd. in Canada, subject to applicable federal, provincial, and municipal laws and regulations.

2. Scope of Services

Maple Crest Garden Services Ltd. may provide one or more of the following services, as agreed in writing, by invoice, estimate, or service order:

  • Garden design and planning
  • Seasonal cleanups
  • Lawn and turf maintenance
  • Tree, shrub, and hedge trimming
  • Flower bed planting and mulching
  • Irrigation system checks
  • Weed control and garden bed care

Any additional work, change in scope, or special requests must be approved by Maple Crest Garden Services Ltd. and may result in revised pricing, scheduling, or service terms.

We may refuse or discontinue services where conditions are unsafe, unlawful, materially misrepresented, or beyond our expertise or available resources.

3. User Obligations and Responsibilities

You agree to:

  • Provide accurate, complete, and current information when requesting services.
  • Ensure lawful access to the property and obtain all necessary permissions from owners, landlords, tenants, condominium corporations, or other authorized parties.
  • Disclose known hazards, including underground utilities, irrigation lines, buried objects, pests, poisonous plants, structural risks, and security concerns.
  • Remove or secure personal property, valuables, fragile items, pets, and obstacles that may interfere with safe performance of the services.
  • Ensure that the work area is reasonably accessible and safe for our personnel and equipment.
  • Comply with all applicable laws, bylaws, rules, and community or property restrictions that affect the services.
  • Promptly notify us of any concerns, defects, or issues discovered in the service area.

You acknowledge that gardening and landscaping services may involve physical work, tools, machinery, soil, plant material, and environmental conditions that can cause damage or loss if hazards are not disclosed or if the site is not properly prepared.

4. Payment Terms and Conditions

Fees for services will be set out in our estimate, quote, service agreement, or invoice. Unless otherwise agreed in writing, all amounts are in Canadian dollars (CAD).

  • Deposits may be required to secure bookings or to cover materials and scheduling commitments.
  • Invoices are payable on the due date stated on the invoice or, if no date is stated, upon receipt.
  • Late payments may be subject to interest at the maximum rate permitted by applicable law, plus reasonable collection costs.
  • We may suspend or refuse future services if payment is overdue.
  • Material and third-party supplier costs may be billed separately unless expressly included in the quoted price.
  • Any estimate is based on the information available at the time and may change if site conditions or requested work differ from the original scope.

You are responsible for all applicable taxes, including GST/HST, unless otherwise stated in writing.

5. Cancellation and Refund Policy

Cancellations or rescheduling requests must be made with reasonable notice. Unless a different policy is stated in your service agreement or invoice:

  • Bookings cancelled less than 24 hours before the scheduled service may be subject to a cancellation fee.
  • Bookings cancelled after we have procured materials, dispatched personnel, or commenced work may be charged for all completed work, incurred costs, and reasonable loss of scheduling time.
  • Deposits may be non-refundable to the extent they cover administrative costs, reserved time, materials, and supplier commitments, unless prohibited by law.
  • Refunds, if any, will be issued only for amounts expressly approved by Maple Crest Garden Services Ltd. or required by applicable law.

If weather conditions, safety concerns, or site conditions prevent safe performance of the services, we may reschedule the appointment or modify the scope as reasonably necessary. Such rescheduling will not automatically entitle the Client to a refund.

6. Liability Limitations

To the fullest extent permitted by applicable law, Maple Crest Garden Services Ltd. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of enjoyment, loss of use, or loss of business opportunities, arising out of or related to the services or these Terms.

Our total aggregate liability for any claim arising out of or relating to the services will not exceed the amount paid by you to Maple Crest Garden Services Ltd. for the specific service giving rise to the claim, except where such limitation is prohibited by law.

We are not responsible for:

  • Pre-existing damage, hidden defects, or conditions not reasonably discoverable prior to service.
  • Damage caused by unsafe, defective, or improperly maintained property conditions.
  • Damage resulting from undisclosed hazards, buried objects, irrigation lines, cables, pipes, or utilities.
  • Plant loss or stress caused by weather, pests, disease, drought, soil conditions, or circumstances outside our control.
  • Delays or inability to perform due to third-party acts, supply shortages, or force majeure events.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, wilful misconduct, or other non-excludable obligations.

7. Intellectual Property Rights

Unless otherwise agreed in writing, all intellectual property, including service methods, designs, concepts, written materials, photos, templates, and documentation created by Maple Crest Garden Services Ltd. remain our property until full payment is received, subject to any rights that cannot be assigned or restricted by law.

Upon full payment, the Client receives a non-exclusive, non-transferable right to use any deliverables created specifically for the Client’s property for the purpose of enjoying and maintaining the services provided.

The Client grants Maple Crest Garden Services Ltd. a limited right to take and use photographs or video of completed work, provided that any personal information or identifying details are handled in accordance with our privacy obligations and any applicable consent requirements.

8. Data Protection and Privacy

Maple Crest Garden Services Ltd. collects, uses, discloses, and retains personal information only as reasonably necessary to provide services, manage scheduling and billing, communicate with clients, comply with legal obligations, and improve our operations.

We will handle personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) where applicable, and any relevant provincial privacy requirements.

  • We may collect contact details, property access information, service preferences, billing information, and related communications.
  • We may share personal information with employees, contractors, payment processors, insurers, advisors, and suppliers only as necessary for legitimate business purposes.
  • We use reasonable safeguards to protect personal information, but no method of transmission or storage is completely secure.
  • You may contact us to request access to or correction of your personal information, subject to lawful exceptions.

9. Force Majeure

Maple Crest Garden Services Ltd. will not be liable for any delay or failure to perform caused by events beyond our reasonable control, including but not limited to severe weather, storms, flooding, wildfire, ice, public health emergencies, labour disputes, supply shortages, transportation interruptions, power outages, acts of government, civil unrest, or utility failures.

In such circumstances, we may suspend, postpone, or modify services without liability, provided we take reasonable steps to communicate and reschedule where practicable.

10. Changes to Terms

Maple Crest Garden Services Ltd. may update or revise these Terms from time to time. The updated Terms will be effective when posted, when communicated to you, or on another specified effective date.

Your continued use of our services after any change becomes effective constitutes your acceptance of the revised Terms. If you do not accept the revised Terms, you must stop using our services.

11. Applicable Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.

Any dispute arising out of or relating to these Terms or the services will be subject to the exclusive jurisdiction of the courts located in Ontario, unless applicable law requires otherwise.

13. Severability Clause

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision will be severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

If any invalid or unenforceable provision can be modified to make it valid and enforceable, it will be interpreted and enforced to the fullest extent permitted by law consistent with the original intent.

By engaging Maple Crest Garden Services Ltd., you acknowledge that you have read, understood, and agreed to these Terms of Service.
